What Could the Noncompete Ban Mean for You and Your Career?

If it takes effect, the noncompete ban could herald a new era of professional freedom. “Anybody who has been working for a brokerage would not be ‘handcuffed’ and tied to that specific company and have to sit out of the game, so to speak, for whatever the specified period of time is before they can reenter the game,” Sean explains. “They’ll be able to freely move immediately.” 

If an agent working for Broker A likes what Broker B has to offer, this potential noncompete ban would allow them to freely work for Broker B with no repercussions. This newfound mobility could empower agents to pursue the best opportunities available to them, fostering a more dynamic and competitive job market.

Everything said to recruit somebody would have ring true 90 days later, six months later and six years later,” Sean explains. “Freight agent programs would need to ensure they’re providing an environment where people want to stay, want to continue to develop their expertise, their skillset and maximize their potential.”

 

Understanding the Distinction: Noncompete vs. Nonsolicit Agreements

Now, it’s important to note that a potential noncompete ban would not impact any nonsolicit agreements in place. While a potential noncompete ban could remove barriers to changing employers, nonsolicit agreements would still stand.

“The noncompete ban does not ban nonsolicits at all,” says Sean. “Companies are still going to do everything they can to try to protect their business interests.”
